1. The agreement
These terms are between Lossworth (“we”) and the organisation that holds the account (“you”). Creating an organisation or using the service accepts them. If you accept on behalf of a firm, you are confirming you have authority to bind it.
2. What the service is
Lossworth is software for preparing a contents inventory: capturing photographs, drafting and correcting line items, computing replacement cost, depreciation and actual cash value from the inputs you supply, and exporting the result.
What it is not. Lossworth is not an insurance carrier, broker, or adjuster; it does not provide insurance, legal, appraisal or tax advice; and it is not a party to your claim. Its output is a working document that a licensed professional reviews, corrects and signs. Valuation figures are estimates produced by a published method from the data entered — they are not an appraisal and not a guarantee of what any carrier will pay.
3. Your responsibility for the output
You are responsible for the accuracy of what you submit to a carrier. The product requires every line to be marked reviewed before it can be exported precisely because that review is yours to perform. Photo analysis produces a first draft that is frequently wrong about quantities, brands and ages; treat it as a starting point, never as a finding.
4. Accounts and crew
The subscription belongs to the organisation, not to a person. Owners and admins may add or remove members and change roles. An organisation must always keep at least one owner. You are responsible for your members' use of the service and for removing anyone who leaves.
5. Your data
Claims, photographs, line items and exports are yours. We claim no ownership of them and use them only to run the service for you. We may use aggregated, de-identified statistics that cannot be traced to you, your firm, or an insured — for example, how many lines a typical claim contains — to improve the product. Handling of personal data is described in the privacy policy.
6. Fees
Plans are billed monthly in advance through Stripe: Crew at $249 per month and Firm at $549 per month, in US dollars, exclusive of tax. Subscriptions renew automatically until cancelled. Cancel at any time from the billing page; access continues to the end of the period you have paid for, and we do not prorate a partial month. Where a trial is offered, its terms are shown before you start it. Prices may change with at least thirty days' notice, never mid-period.
If payment fails, the claims surface locks until billing is current. The billing page stays reachable so you can fix it, and your data is not deleted for non-payment.
7. Acceptable use
- Do not upload content you have no right to hold or process.
- Do not use Lossworth to prepare a document you know to be false. Fabricating an inventory line, or altering a computed figure by any means, is insurance fraud and ends the account immediately.
- Do not attempt to reach another organisation's data, probe the service's security, or resell access.
- Do not scrape or automate the interface beyond ordinary use of the documented API.
8. Availability
We aim for the service to be available whenever you need it, and we do not currently offer a contractual uptime commitment. Maintenance that requires downtime is announced in advance where we can. The service is provided “as is” and, to the extent the law allows, without warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business. Our total liability for any claim arising out of these terms is limited to the fees you paid in the twelve months before the event giving rise to it. Nothing here limits liability that cannot be limited by law.
10. Ending it
You may cancel or delete your account at any time from the billing page. We may suspend or end an account for a material breach of these terms, with notice and a chance to fix it where the circumstances allow. Export your claims before you delete an account: deletion removes the data and the stored photographs, and it cannot be undone.
11. Changes
We will give at least thirty days' notice in the product before a material change to these terms takes effect. Continuing to use the service after that is acceptance; if you would rather not, cancel and we will refund the unused part of the period.

Xactimate and XactContents are trademarks of Verisk Analytics, Inc. Lossworth is not affiliated with or endorsed by Verisk. References to them describe file compatibility only.
13. Governing law and contact
These terms are governed by the law of the State of North Carolina, USA, and the parties submit to the courts sitting there. Questions: legal@lossworth.com.
